WAIVER AND RELEASE AGREEMENT
THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.
IN CONSIDERATION FOR MY BEING PERMITTED TO PARTICIPATE IN ANY ACTIVITIES I MAY CHOOSE DURING MY STAY AT SHAWNEE CREEK HORSE CAMPLLC, I AGREE TO THE FOLLOWING WAIVER AND RELEASE.
I acknowledge that activities in any natural wilderness has inherent risks, hazards, and dangers for anyone, that cannot be eliminated. I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE WITHOUT LIMITATION;
1. The propensity of the animal to behave in ways that may result in injury, harm or death to persons or other animals on or around
2. The unpredictble of the animal's reaction to such things as sounds, sudden movement, and unfamilar objects such as other animals (domestic or wild), or people;
3. Certain hazards such as surface and sub-service conditions;
4. Collision with other animals, persons or objects;
5. The potential of the participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within his or her ability. I may encounter variations in terrain that are my responsibility and I assume these risks including creeks, water, bridges, traveled roads, wild things, including venomous snakes, insects, and plants. I may also encounter stumps, forest growth, debris, rocks and cliffs, fences, and other obstacles whether they are obvious or not obvious;man-made or natural;
6. Hiking, walking, rinding in rugged country;
7. Encounter with wildlife, animals and other persons;
8. Temperature extremes, and flash flooding;
9. Inclement weather conditions and the unavailability of immediate medical attention in the rural or wilderness in case
of injury.
10. The risk of handling firearms and being near others that have firearms in their possession.
11. The risk of other reckless behavior and being near others that may do so.
I understand the risks, hazards and dangers of horseback riding, camping and other outdoor activities. I understand that there is live water on the property and that I will be responsible for myself, and minor children, either biological children or those I choose to accompany me. While I or they are near any river, stream or other water source, man made or natural. I have discussed these risks with ____________________________; a representive of SHAWNEE CREEK HORSE CAMP LLC. I understand that these activities may require good physical conditioning and a degree of skill and knowledge. I believe that I , and ANY MINOR CHILDREN I have chosen to accept responsibility for, have that good physical conditioning and the degree of skill and knowledge necessary to engage in these activities safely. I understand that I have responsibilities pertaining to the safety of myself, any minors in my care, my animals and my belongings. My participation, and the participation of minors in my care is purely voluntary. No one is forcing me (us), to participate and I, (we) elect to participate in spite of the risks. I (WE) AM VOLUNTARILY USING THE SERVICES OF SHAWNEE CREEK HORSE CAMP LLC. WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, PARALYSIS, OR DEATH.
IF I AM ACCOMPANIED BY MINORS, I ACCEPT THE RESPONSIBILY FOR PROVIDING PROOF OF CUSTODIAL PARENTAL CONSENT FOR HIM OR HER TO A REPRESATIVE OF SHAWNEE CREEK HORSE CAMP LLC.

Lastly, I, myself, my heirs, successors, executors, executors, and subrogates, hereby KNOWLINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMINIFY AND HOLD HARMLESS SHAWNEE CREEK HORSE CAMP LLC, their directors, officers, agents, employees, and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses(including reasonable attotnys' fees) which are related to, arise out of, or are in any way connected with my participation in this activity including, but not limited to, NEGLIGENCE of any kind of nature, whether
foreseen or unforeseen, arising directly or indirectly out of any damage, loss injury, paralysis or death to me or to my property as a result of my engaging in these activities or the use of these services, animals or ecquipment, whether such damage, loss, injury, paralysis, or death results from negligence of SHAWNEE CREEK HORSE CAMP LLC, or from some other cause. I, for myself, my heirs, my successors, executors, and subrogates, furthur agree not to sue SHAWNEE CREEK HORSE CAMP LLC. as a result of any injury, paralysis, or death suffered in connection with my use and participation in any activities during my stay at SHAWNEE CREEK HORSE CAMP LLC.
